Following a warning about using this pharmacist’s website, a new statement has confirmed his disciplinary history

Earlier this month, NSW Fair Trade Commissioner Rose Webb warned consumers not to deal with discountepharmacy.com.au, a website registered to and managed by David Le, trading as Chemist Max.

Consumers had been complaining about not receiving goods ordered and paid for via the site, which promoted health and wellbeing products, supplements, cosmetics and analgesics.

Customers had found it difficult to contact anyone at discountepharmacy.com.au, and had been forced to resort to seeking a chargeback option from their banks where they had paid by credit card.

People who had had problems using the site were urged to report them to Fair Trading.

Now, Fair Trading NSW has issued an updated statement confirming that Mr Le is the same practitioner who, in 2019, was convicted of holding himself out as a registered pharmacist.

“In 2017, the Pharmacy Council of NSW imposed an interim suspension on Mr Le’s registration as a pharmacist,” says Fair Trading.

“In 2019, the Australian Health Practitioner Regulation Agency (AHPRA) took prosecution action against Mr Le for falsely purporting to be a registered pharmacist. Mr Le plead guilty in the NSW Local Court, was fined $24,500 and remains suspended by AHPRA.”

There are three David Les whose registration details as pharmacists are currently held by AHPRA in NSW, all with their principal place of practice listed as Sydney suburbs.

A search of the Australian Business Register reveals that Chemist Max was registered from 1 October 2010, trading under that name from 6 August 2014, with an ABN registered to David Le.

From its registration until 13 September 2014, it was located at an address within the 2196 postcode (Roselands and Punchbowl), moving to the Sydney 2000 postcode on 6 May 2016, where it is still currently listed.

The historical details for the ABN associated with the business are also associated with one Sydney City Pharmacy, between 3 November 2010 and 17 November 2018.

The trading name associated with this ABN, Sydney City Pharmacy, is still current. An earlier name, David Le, was current from 1 October 2010 to 3 November 2010.

The David Le in question – registration number PHA0001049696 – is listed as principally practising in Punchbowl, 2196.

His registration expired on 30 November 2017 and is currently suspended.

In March 2019, the AJP reported that Mr Le had been convicted by a NSW court of holding himself out as a registered pharmacist, after AHPRA filed charges against him.

The Pharmacy Council of NSW had placed an interim suspension on his registration.

AHPRA charges alleged that Mr Le had continued to open and operate the Sydney City Pharmacy alone, without a registered pharmacist on duty.

On 27 March 2019 Mr Le was convicted and a magistrate imposed an aggregate fine of $24,500. He was ordered to pay legal costs to AHPRA of $15,000.
